These terms and conditions ("Terms") govern the use of the Slapfish Scratch & Win Cards ("Cards") offered as a promotion by The Slapfish Company LLC, hereinafter referred to as "Slapfish" or "we."
By participating in the Slapfish Scratch & Win Card Promotion and by using, or redeeming a Slapfish Scratch & Win Card, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. Promotion Dates: Eligible individuals can participate in the Slapfish Scratch & Win Card Promotion (“Promotion”) from November 1, 2023 to March 31, 2024.
2. Eligibility: The Slapfish Scratch & Win Cards are available to individuals who are legal residents of the U.S. who are 18 years of age or older as of November 1, 2023. Employees of Slapfish and their immediate family members are not eligible to participate in this Promotion. For the purposes of this Promotion, “immediate family members” means parents, grandparents, siblings, children, grandchildren, and their respective spouses. This Promotion is subject to all applicable federal, state and local laws and regulations. Void outside the U.S. and where prohibited.
3. How to Play: A total of 22,000 cards will be distributed in-store at participating Slapfish locations during the Promotion dates. To determine if you have won, scratch off your Card to determine your Prize before the expiration date printed on the Card.
4. Card Redemption: Cards can only be redeemed at participating Slapfish locations. Please visit our website or contact your nearest Slapfish restaurant for a list of participating locations. To redeem a Card, you must present and surrender the physical Card to a Slapfish staff member at the time of payment. Digital copies or photocopies of Cards will not be accepted. Only one Card can only be redeemed per transaction and cannot be combined with any other offer or discount.
5. Prizes: Prizes are predetermined and may include discounts, free menu items, or special promotions (each a “Prize” and collectively, “Prizes”). The specific prize(s) available on the Card will be indicated at the time of purchase. Prizes are subject to change and may vary by location. Slapfish reserves the right to substitute a Prize of equal or greater value. Prizes cannot be redeemed for cash. Prizes cannot be transferred to another person. All applicable local, state, and federal taxes, including without limitation, income taxes resulting from acceptance of Prize are the responsibility of winner.
All Prizes must be redeemed from January 1, 2024 through March 31, 2024. Expired Cards will not be accepted.
a. Four Grand Prizes: Each Grand Prize winner will receive 'Free Lobster for One Year' as the grand Prize. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish. Upon notifying Slapfish, $360.00 in credit, which is the equivalent of approximately one lobster roll per month, will be added to the Registered User Account on the Slapfish Loyalty Rewards App. The Prize will remain valid until December 31, 2024.
b. 996 Free Lobster Roll Prizes: 996 winners will receive a ‘Free Lobster Roll’. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish.
c. 3,000 Free Flagship Entrée Prizes: 3,000 winners will receive a ‘Free Flagship Entrée’. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish.
d. 3,000 Free Create-Your-Own-Voyage Entrée Prizes: 3,000 winners will receive a ‘Free Create-Your-Own-Voyage Entrée’. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish.
e. 5,000 Free Side Prizes: 5,000 winners will receive a ‘Free Side’. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish.
f. 8, 000 Free Beverage Prizes: 8,000 winners will receive a ‘Free Beverage’. To qualify, participants must use the Slapfish Loyalty Rewards App. Upon winning, the Prize will be credited to the winner's Slapfish Loyalty Rewards Registered User Account after notifying Slapfish.
6. Winner’ List: For the names of all Prize winners, available after April 1, 2024, send a self-addressed, stamped

7. Lost or Stolen Cards: Slapfish is not responsible for lost, stolen, or damaged Cards. Cards cannot be replaced if lost or stolen.
8. Card Expiration: Each Card has an expiration date printed on it. Cards must be used and the Prizes redeemed before the printed expiration date.
9. Limitations: Slapfish reserves the right to limit the number of Cards that can be used by an individual or household. Cards are not for resale. Any resale or attempt to resell Cards may result in the cancellation of the Card.
10. Card Purchase: Cards cannot be purchased at participating Slapfish locations. Cards will be distributed at participating Slapfish locations with all orders and in all to-go orders that are made in-store or online. Limit one card per order.
11. Modification or Termination: Slapfish reserves the right to modify or terminate the Promotion or these Terms at any time, without notice.
12. Limitation of Liability: By entering this Promotion, entrants waive all right to, and hold Slapfish harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Promotion or the acceptance, use, or misuse of any Prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Slapfish will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive Prize notices due to entrant’s security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Promotion; by any human error which may occur in the processing of the entries in this Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, or announcement of the Prizes. If, in Slapfish’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Promotion, or if technical difficulties (including viruses and bugs) compromise the integrity of the Promotion, Slapfish reserves the right to, in its sole discretion, cancel or modify this Promotion in a manner deemed appropriate by Slapfish.
13. Privacy: By participating in this Promotion, you consent to the collection and use of your personal information for the purposes of administering the Promotion, as well as for marketing and promotional activities, as described in our Privacy Policy on our website.
14. Governing Law: These Terms and the Promotion and any disputes arising under or in connection with them shall be governed by and construed in accordance with the laws of Harris County, Texas.

By redeeming a Slapfish Scratch & Win Card, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Slapfish reserves the right to make changes to these Terms at its discretion. Please check the Terms provided on our website regularly for updates.
